Domestic Executive Charter Tariff
Background information
The Canadian Transportation Agency requires that all commercial air services in Canada providing publicly available services, and therefore licensed by the CTA, maintain a domestic tariff.
On CTA inspections to operators, the Inspector requires that domestic tariff to be available. If the operator has not prepared a tariff, it provides the operator with the CTA generic tariff, which in our opinion is totally inapplicable to any operations, other than mainline scheduled and charter operators all utilizing large aircraft.
Due to the fact that under Section 67 of the Canada Transportation Act, the operator tariffs are deemed as the true contractual conditions between the commercial air service and the passenger/shipper, and the CTA is more than willing to accept subpoenas to appear in Court on disputes between commercial air services and their customers, it is therefore prudent for the air carrier's tariff to be either totally congruent with the commercial terms in its Charter Contract, or to be void of commercial terms and only contain liability and operational provisions.
For that reason, and for the benefit of the CBAA members who are operating CTA licensed services, we have created the attached Domestic Executive Aircraft Charter Tariff, which we are making available to CBAA members operating commercial air services.
Similarly, those commercial air services are required, if licensed for international services, to file with the CTA an international charter tariff. Similarly, we have prepared a tariff for those types of operations, which in our opinion is a tariff suitable for the international executive aircraft operations, as opposed to the International Charter Tariff that is provided on a generic basis by the CTA. Similarly, we will make that available to any CBAA members who request the same.
