The purpose of this section is to enable CBAA Members to find up to date information on the CBAA POC Program transition period to Transport Canada on April 1, 2011. Check back for updates as they become available.
Regulatory development continues with a TC lead consultation focus group, scheduled for 29 - 31 May, whose recommendations will be submitted to TC and should form the basis for a possible regulatory framework which will be published in Gazette Part 1 next year. The CBAA will be well represented on this group. This means that the Interim Order will be reissued and that a new Subpart 604 will not likely be published until late next year. It is the CBAA's belief that this extended process is the best chance business aviation has to end up with a regulatory framework that supports the growth of business aviation in Canada and permits TC to assure business aviations operations remain safe.

Transport Canada has advised that those operators that also hold an AOC may largely base their policy/procedures on a commitment to maintaining the standards of 704 with reference to another company document such as an MPM or MCM. A check sheet for use in this situation is available to download below. This checklist will permit operators to review their Company MPM/MCM/POC Manual/COM to ensure that all the requirements of Division VIII of the Interim Order are adequately addressed.
The Business Aviation Operational Safety Standards (BAOSS), at a minimum, required audits of the Safety Management System every three years and some Temporary Private Operators Certificate (TPOC) holders may be approaching the time when their audits will expire. Transport Canada recently published their audit policy in paragraph 12 of the section entitled Converting a CBAA Certificate into a Transport Canada Certificate section of their Questions and Answers website. The 1 April 2011 Interim Order defines the current regulatory requirements for private operators. It adds some new regulatory requirements not in the BAOSS and changes some current BAOSS requirements. It should be noted that the order will be reissued every two weeks until after the election when it can be formally approved by the government and issued in its final form by Transport Canada. The reissued versions will have no changes from the version issued on 1 April 2011; therefore, there is no need to review these subsequent versions for changes.
